Data protection
Data protection
Data protection declaration for the Clever One GmbH website and the collection of personal data in accordance with the GDPR
Thank you for visiting our website and would like to inform you as comprehensively as possible about the associated processing of your data. We will inform you about your rights and the contact details of our data protection officer at the end of this privacy policy.
Based on the decision of the European Court of Justice of 16.07.2020, we hereby inform our customers, business partners, employees, website visitors and other communication partners that, when using US service providers such as Amazon, Asana, Facebook, Google, MailChimp, Twitter, TeamViewer, YouTube, etc. and their respective European subsidiaries, an adequate level of data protection comparable to EU rules may not be maintained during communication. On the basis of national laws, a non-European provider may be forced under national law to release communication data to national safety authorities without this disclosure being able to verify its legality in independent court proceedings at the request of the person concerned. Since this finding of the court also applies to companies based and data processing in Europe under the so-called EU-US Privacy Shield, as well as the standard contractual clauses and binding corporate regulations, we must now check all data transfers to third parties on a case-by-case basis and, if necessary, discontinue or replace them with EU-based providers. We are currently discussing this with our service providers and regulatory authorities.

1. Cookies
We use cookies. Cookies are text files that are stored and stored on a computer system via an Internet browser.
Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters through which websites and servers can be assigned to the specific Internet browser in which the cookie was stored. This enables the websites and servers you visit to distinguish your individual browser from other Internet browsers that contain other cookies. A specific Internet browser can be recognized and identified via the unique cookie ID. By using cookies, we can provide users of this website with more user-friendly services. Information and offers on our website can be optimized for the user, for example by recognizing the user of the website. This means that access data does not have to be entered again every time you visit the website, as this is taken over by the website and the cookie stored on the user's computer system.
However, when using cookies, a distinction must be made with regard to various purposes. Insofar as these small files are absolutely necessary to properly display the website, their use is not voluntary. In this case, the legal basis for the integration of cookies is Art. 6 (1) lit. f GDPR.
However, cookies are also used on the website for the purpose of analyzing user behavior or marketing purposes. However, this use only takes place if you have given us your consent in accordance with Art. 6 (1) lit. a DSGVO the first time you visit the website. However, you can prevent cookies from being set by our website at any time by means of an appropriate setting in the Internet browser used and thus permanently object to the setting of cookies. In addition, cookies that have already been set can be deleted at any time via an Internet browser or other software programs. This is possible in all common Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable.
We have put together links below which you can find detailed information on how to disable cookies in common browsers:
Mozilla Firefox
Internet Explorer
Google Chrome
safari
2. Server log files
The provider of our website automatically collects and stores information in so-called server log files, which are automatically transmitted to us by your browser. The following can be recorded:
(1) the browser types and versions used,
(2) the operating system used by the accessing system,
(3) the website from which an accessing system accesses our website (so-called referrer),
(4) Sub-websites, which are accessed via an accessing system on our website,
(5) the date and time of access to the website,
(6) an Internet protocol address (IP address),
(7) the Internet service provider of the accessing system and
(8) other similar data and information used to avert threats in the event of attacks on our information technology systems.
When using this general data and information, we do not draw any conclusions about you. Rather, this information is needed to
(1) to deliver the content of our website correctly,
(2) to optimize the content of our website and advertising for it,
(3) to ensure the long-term functionality of our information technology systems and the technology of our website, and
(4) Provide law enforcement authorities with the information necessary for prosecution in the event of a cyber attack.
We therefore analyse this data and information statistically on the one hand and also with the aim of increasing data protection and data security in our company in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data in the server log files is stored separately from all personal data you have provided. This data is not combined with other data sources. However, if there is evidence of illegal use of our website, we are able to review this data retrospectively.
3. Contact form
Due to legal regulations, our website contains information that enables quick electronic contact with our company and direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If you contact us by email or via a contact form, the personal data you provide will be automatically stored. Such personal data provided on a voluntary basis will be stored for the purpose of processing or contacting you. There is no transfer of this personal data to third parties.
4th newsletter
4.1. Order newsletter
On our website, you can subscribe to a free newsletter at any time, i.e. consent to receive the newsletter.
You can order our newsletter using a double opt-in procedure. This procedure consists in that, after registration, you will receive an email asking you to confirm your registration. This step is necessary so that no one can log in with someone else's email address. We log this registration to prove the registration process in accordance with legal requirements and to prevent misuse. For this purpose, we process the time of registration and confirmation and your IP address.
In addition, your personal data will be sent to us from the input screen when you register. To order the newsletter, it is sufficient to provide an e-mail address. Optionally, you can enter your first and last name as well as your title. This information is required in order to be able to address you personally with the newsletter.
Alternatively, you are welcome to send us an email to info@cleverone.io with an express request to add you to our newsletter mailing list.
Your personal data will be stored as long as you have subscribed to the newsletter. In principle, this data is not passed on to third parties and is used exclusively to send the newsletter. However, we reserve the right to use professional service providers to send and manage our newsletter. The service providers used for these purposes may also receive your data, but only if and to the extent that they, as contract processors, guarantee compliance with the legal requirements of the GDPR and have concluded an agreement with us for order data processing.
If you have given your consent, we will use your email address to send you our newsletter regularly. The legal basis is Art. 6 (1) (a) GDPR.
4.2 Unsubscribe from newsletters
You can unsubscribe from our newsletter at any time and thus withdraw your consent to receive the newsletter. You can unsubscribe from the newsletter via a link at the end of each newsletter. Alternatively, you can send your request to unsubscribe by email to info@cleverone.io.
5. Application options
We collect and process the personal data of applicants for the purpose of processing the application process. Processing can also be carried out electronically. This is particularly the case if an applicant submits relevant application documents to us electronically, for example by e-mail or via a web form on our website.
If an employment contract is concluded with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with legal requirements. If we do not conclude an employment contract with the applicant, the application documents will be automatically deleted six months after notification of the rejection decision, provided that deletion does not conflict with any other legitimate interests on our part.
Other legitimate interest in this sense is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG). Should applicants and employers be interested in joining an applicant pool and therefore in storing the data for a longer period of time, appropriate consent from the applicant is required. In this case, the applicant will be informed of the company's privacy policy and the company's specific applicant data protection provisions. In order to ensure verifiability, a written declaration of consent to data processing for the purpose of the application will then be obtained and, at the same time, the applicant will be informed that consent can be withdrawn at any time with effect for the future.
6. Google Maps
As part of our website, for example to find branches and/or locations of our company, interactive maps from the “Google Maps API” map service provided by Google LLC are used.
The operating company is Google LLC; 1600 Amphitheatre Parkway; Mountain View, CA 94043; USA. When using this service, information about the use of the source website, as well as your IP address, is transmitted to Google LLC servers in the USA and stored. We cannot rule out the transfer of your data to third parties, for example in the case of legally required transfers or the processing of data by third parties on behalf of Google LLC. Google's privacy policy can be found here: http://www.google.com/policies/privacy/.
If you do not want the data to be transferred, the map service can be deactivated and thus the transmission of data to Google LLC can be avoided. To do this, you must deactivate the Java Script in the browser.
7. 3D tour
We offer our customers a 3D tour of our premises using the services of Matterport Inc., 352 E. Java Dr. Sunnyvale, CA 94089, USA.
You will receive an access link from us for this. If you click on this link, you will be redirected to the service provider. Matterport processes your IP address, browser version and display device, origin and destination URL, and the ID of the respective 3D tour. This information is processed on servers in the USA. For more information on how to handle user data, please see Matterport's privacy policy at: https://matterport.com/legal/privacy-policy/.
II. Social media
1. Use of social media plug-ins
The website also uses the integration of social media platforms, such as Facebook, Twitter and Google+. These platforms sometimes contain buttons and plugins that transfer data to the operators of the respective network platform as soon as the page is loaded, i.e. without further user activity.
In order to ensure that your personal data is protected in the best possible way, we use a two-stage solution developed by heise online, which only transmits data with the consent of the user.
By default, buttons are used that do not establish contact with Facebook servers and other social media networks. The respective button therefore does not initially transfer any data to third parties. Only when you, as a user, activate the corresponding button and thus give your consent to communicate with Facebook, Twitter, Instagram or Google, do the buttons become active and establish a connection. With a second click, you can then share your recommendation with your own network. If you click on one of the buttons to activate it, you give your consent to transfer data to the respective operator of the social network. If you are already logged in to the respective social network at the time you activate the button, sharing on Facebook and Google+ takes place without another window, according to the current state of technology.
2. Facebook
2.1. Facebook - General
We have integrated components from the company Facebook on this website. Facebook is a social network.
A social network is a social meeting place operated on the Internet, i.e. an online community that usually enables users to communicate with each other and interact in virtual space. A social network can serve as a platform for exchanging opinions and experiences or enables the Internet community to provide personal or company-related information. Facebook allows users of the social network, among other things, to create private profiles, upload photos and connect via friend requests.
Clicking on third-party websites such as Facebook is redirected to the respective third party over which we have no control.
The operating company of Facebook is Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. If a data subject lives outside the USA or Canada, the person responsible for processing personal data is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
Each time you access one of the individual pages of this website, which is operated by us and on which a Facebook component (Facebook plug-in) has been integrated, the Internet browser on your system is automatically prompted by the respective Facebook component to download a representation of the corresponding Facebook component from Facebook. A complete overview of all Facebook plug-ins can be found at https://developers.facebook.com/docs/plugins/?locale=de_DE. As part of this technical process, Facebook receives information about which specific sub-page of our website you are visiting.
If you are logged in to Facebook at the same time, Facebook recognizes which specific sub-page of our website you are visiting each time you visit our website and for the entire duration of your respective stay on our website. This information is collected by the Facebook component and assigned to your Facebook account by Facebook. If you click on one of the Facebook buttons integrated on our website, such as the “Like” button, or make a comment, Facebook assigns this information to your personal Facebook user account and stores this personal data. Depending on your privacy settings, this may make your preferences visible to your Facebook friends.
Facebook receives information via the Facebook component that you have visited our website whenever you are logged in to Facebook at the same time as you access our website; this takes place regardless of whether you click on the Facebook component or not.
If you do not want this information to be transmitted to Facebook in this way, you can prevent it from being transmitted by logging out of your Facebook account before accessing our website.
The data policy published by Facebook, which is available at https://de-de.facebook.com/about/privacy/, provides information about the collection, processing and use of personal data by Facebook. It also explains which settings Facebook offers to protect your privacy. There are also various applications available that make it possible to suppress data transmission to Facebook, such as the Facebook blocker from the provider Webgraph, which can be purchased at http://webgraph.com/resources/facebookblocker/. You can use such applications to suppress data transmission to Facebook.
2.2. Facebook - fan page and insight data analysis
The Conference of Independent Federal and State Data Protection Authorities (Data Protection Conference — DSK) has pointed out that Facebook is required to obtain effective consent to the use of data from all visitors to the Facebook page. The operators of a Facebook fan page, on the other hand, are obliged to obtain the necessary information about Facebook's use of data. These requirements cannot currently be implemented by us as operators of Facebook fan pages, as Facebook has not yet fully met its obligations. When you visit our fan page, Facebook collects personal user data within the scope and scope of its responsibility. Such data collection by Facebook can also take place from visitors to this page who are not logged in to Facebook or registered as members. Information about data collection and further processing by Facebook, as well as information about the implementation of your rights and choices, can be found in Facebook's privacy policy at www.facebook.com/help/568137493302217.
By using the Facebook platform, we assume no responsibility for the processing of personal data and its transfer outside the European Union, in particular no responsibility for the implementation of data subject rights and for the effectiveness of consent. The fan page operator cannot understand which user data Facebook collects. We have no influence on the scope and full access to the collected data or your profile data. As part of FaceBook's sole responsibility, you decide which information we receive using your Facebook settings or your browser settings when you visit a publicly accessible page.
In addition, in your Facebook settings (www.facebook.com/settings), you have the option to actively hide your “likes” or to stop following the fan page. Your profile will then no longer appear in the list of fans of this fan page. We receive anonymous statistics from Facebook on the use and use of the fan page. For example, the following information is provided here (so-called insight data):
Followers: Number of people who follow our fan page — including growth and development over a defined time frame
Reach: Number of people who see a specific post on our fan page and number of interactions on a post
Ad performance: number of people who saw an ad
Demographics: Average age of visitors, gender, place of residence, language.
We use these statistics, from which we cannot draw any conclusions about individual users, to constantly improve our online offering on Facebook and to better respond to the interests of our users. We are unable to link the statistical data with the profile data of our fans. You can use your Facebook settings to decide how targeted advertising is displayed to you. We have reached an agreement with Facebook between joint controllers in accordance with Article 26 GDPR regarding the processing of personal data. You can view them here: www.facebook.com/legal/terms/page_controller_addendum.
As a result, Facebook is the sole responsible party for processing insight data. In this regard, Facebook is responsible for fulfilling information obligations in accordance with Articles 12, 13 GDPR, for exercising data subject rights in accordance with Articles 15 - 22 GDPR, for data security and also for reporting data breaches (Articles 32 - 34 GDPR). Facebook remains the sole responsible party for the processing of other personal data.
We receive personal data via Facebook when you actively share it with us via a personal message on Facebook or when you use a form with pre-filled fields with data from your profile to send the data to us and actively send the data to us by clicking on a button. We use the data you provide (e.g. first name, last name, customer number) to answer your request in our customer service department, if this is necessary. Your data is stored in our CRM system for this purpose. For more information about how we process personal data and about your rights, please see our privacy policy.

III. Analysis tools
1. Google Analytics (with anonymization function)
We have integrated the Google Analytics component (with anonymization function) on our website.

As a result of the abbreviation of the IP addresses of website visitors already carried out when using Google Analytics, a direct personal reference is not established. A personal reference may arise as a result of viewing the linked company information.
